1. Acceptance of terms

These Terms of Service ("Terms") govern your use of this website and of the JasMed software and licensing/AMC services provided by Jas Infinity Software and Development Company ("Jas Infinity", "we", "us"). By accessing the site, or by activating or using a JasMed licence, you agree to these Terms. If you do not agree, do not use the services.

2. Licence

Subject to payment of the applicable fees, we grant you a non-exclusive, non-transferable licence to use JasMed on a single computer, identified by its Machine ID, for your internal clinic operations. Each licence is bound to one machine.

You may not copy, resell, sublicense, rent, reverse-engineer, modify or attempt to circumvent the licensing or security mechanisms of the software, except to the extent permitted by law.

3. Annual Maintenance (AMC) & renewals

JasMed licences are issued for a fixed term (typically one year). Continued use after the term requires renewal of the Annual Maintenance Contract (AMC). You can activate or renew by sending your Machine ID and paying the AMC fee, online or offline. On confirmation we issue a new signed license.key valid for the next term.

4. Fees & payments

Fees are stated in Indian Rupees (₹) and are payable in advance. Online payments are processed by Razorpay; by paying online you also agree to their terms.

Auto-renew (e-mandate). Where you enable auto-renew, you authorise a recurring yearly charge for the AMC fee against the card, UPI or bank account you approve, and each successful charge issues and emails a new licence for the next term. You may enable it in two ways, and both are optional:

  • At the time of purchase. If you leave the auto-renew option ticked when buying a licence, you approve one payment of the one-time licence fee, charged immediately, and separately register a mandate for the yearly AMC fee. The AMC is not charged on the day you buy. Its first charge falls due when your first year ends, and yearly thereafter. The amount and the first charge date are shown to you before you approve the mandate.
  • Later, from your account, on a licence you already hold. The first charge then falls due when your current term expires, so enabling auto-renew never shortens a term you have already paid for.

Auto-renew continues for the number of yearly cycles stated when the mandate is created, unless cancelled sooner.

Cancelling auto-renew. You may cancel at any time, and the following applies:

  • How to cancel. Sign in to your account and use Cancel auto-renew on the licence concerned. That is the authoritative method and takes effect immediately. You may also email contact@jasinfinity.com, in which case cancellation takes effect when we action it, and we ask for at least five (5) working days before the next scheduled charge date. A cancellation request sent by any other route, or received later than that, may not stop a charge that is already in progress.
  • What cancelling does. It stops future charges only. Your licence remains valid to the end of the term you have already paid for, and then lapses unless renewed.
  • What cancelling does not do. It is not a refund request and does not entitle you to a refund, in whole or in part, of the current term or of any earlier term. Fees already charged are not refundable on cancellation.
  • Charges already initiated. A charge that has been initiated, presented to your bank, or is within its pre-debit notification window before we receive your cancellation will be completed, and the term it pays for will be issued to you in full. This is not a charge in error.
  • Cancelling at your bank. You may also revoke the mandate through your bank or UPI application. Doing so stops the money but does not notify us, does not cancel your licence obligations, and will result in your licence simply lapsing at expiry with no renewal notice from us. We recommend cancelling in your account instead.
  • Reinstating. You can set auto-renew up again at any time from your account; the new mandate is a fresh authorisation on current terms and pricing.

Failed charges. If a scheduled charge fails we will notify you at the email and phone on your account, and Razorpay may retry it for a short period. We may, at our discretion and without obligation, extend your licence by a short grace period while that happens. If the mandate ultimately does not pay, the licence lapses on its expiry date and JasMed will stop working until it is renewed. Maintaining a valid, funded payment instrument on your mandate is your responsibility, and we are not liable for any loss, disruption or downtime arising from a mandate that fails, is revoked, or is attached to an expired or closed card or account.

Your record of consent. When you authorise, are charged under, or cancel a mandate, we record the fact, the amount and frequency you agreed to, the date and time, the version of these Terms then in force, and the network address the action came from. We retain that record for as long as required to answer any dispute, audit, chargeback or statutory enquiry, and it may be produced as evidence of your authorisation. See our Privacy Policy.

Disputes and chargebacks. If you believe a charge is wrong, contact us first and we will investigate in good faith. Raising a chargeback with your bank for a charge validly taken under a mandate you authorised — including a renewal you did not cancel in time — is a breach of these Terms, and we reserve the right to produce the consent record described above, to recover the disputed sum together with any fee levied on us by the payment network, and to suspend or terminate the licence and any related services until the matter is resolved.

Price changes. We may revise the AMC fee for future terms. An existing mandate continues to charge the amount you authorised; where a revised fee is to apply we will give you reasonable notice in advance of the renewal date, and you may cancel before it takes effect. Continuing to allow the mandate to charge after that notice constitutes acceptance of the revised fee.

5. Refunds

Because a licence is a digital good delivered immediately on issuance, fees are generally non-refundable once a licence has been issued for the term, except where required by law or expressly agreed by us in writing. If you believe a charge was made in error, contact us promptly and we will review it in good faith.

6. Acceptable use & your responsibilities

  • You are responsible for operating the software lawfully, including any healthcare, data-protection and record-keeping obligations that apply to your clinic.
  • You are responsible for your own data, backups and the security of the computer and network on which JasMed runs.
  • You must not use the services for any unlawful purpose or in a way that infringes the rights of others.
  • You are responsible for keeping your licence file and login credentials secure.

7. Intellectual property

JasMed, this website, and all related software, designs, trademarks and content are owned by Jas Infinity and protected by applicable laws. These Terms grant you a licence to use the software, not any ownership of it. All rights not expressly granted are reserved.

8. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. Note that JasMed stores patient and clinical data locally on your computer; we do not receive or process it.

9. Warranties & disclaimers

We provide the services with reasonable care and skill. However, to the maximum extent permitted by law, the software and services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, uninterrupted operation, or that the software will be error-free. The software is a clinic management aid and is not a substitute for professional medical judgement.

10. Limitation of liability

To the maximum extent permitted by law, Jas Infinity shall not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits, revenue or goodwill, arising from or related to your use of the services. Our total aggregate liability for any claim shall not exceed the fees you paid for the licence in the twelve months preceding the claim.

11. Suspension & termination

We may suspend or terminate a licence if these Terms are breached, including non-payment or misuse of the software. On termination your right to use the software ends; provisions that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

12. Governing law

These Terms are governed by the laws of India, and the courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute, subject to any non-excludable rights you may have under applicable law.

13. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision, and continued use of the services after a change constitutes acceptance of the updated Terms.
